Limited Civil Court 35 Interrogatories

I understand the limit of 35 interrogatories includes: specially prepared interrogatories; request for admissions; production of documents.

Are form interrogatories included in the 35 limit or not?

Yes, the limited civil form interrogatories (DISC-004) count against the 35, and you would also want to use DISC-001 interrogatory 17.1 in connection with your Requests for Admissions.

In CA in a limited civil action each party has 35 total requests (form, special rog, doc request, admissions) and one deposition.

I agree with Mr. Stone. Unlike unlimited civil actions, discovery in a limited civil action is, well, limited. I do not agree with checking form interrogatory no. 17.1, because this interrogatory appears on the form interrogatories for unlimited civil cases.

You cannot use that form, because Code of Civil Procedure section 94 forbids the use of interrogatories with subparts.

Unfortunately, DISC-004, which is used in limited civil cases, does not contain an interrogatory similar to 17.1, although it would have been nice for the Judicial Council to provide an equivalent.

The two responses you received are good, but both assume that your case is filed as a limited jurisdiction matter as opposed to unlimited jurisdiction. The answers would be different if it is an unlimited case.
