Legal Question in Civil Litigation in California
Live in the City Of Huntington Beach, dealing with a city 70 ft pine tree damaging our property, In 2007 they stated the damage was not due to the tree, therefore they wouldn't cut the tree down. Now in December 13, 2007. Send a letter stating the tree does meet the city council requirements of damaging our property and we can remove the tree and replace the sidewalk that lifted it, At the homeowners expense (that would be us). I am wondering with the letter stating that they now acknowledge that it is the tree causing this damage, how do I fight this to get them to pay, they claim they have no budget or funds for this tree. I have already talked with a reporter with our daily paper. Please help the little man.

The statute of limitations for property damage is generally 3 years. You could have brought a suit before but it seems it is too late now by a few months.
