Legal Question in Civil Litigation in California

locating a person after small claims case is won

It's been over 30 days since I won my small claims case which involved suing another party for $770 for a car loan that the defendant has avoided to pay back. Now that I have waited the mandatory 30 days, the defendant has quit his job, I do not have a phone number or address to contact him at. My question is: How would I be able to locate this person without any information except for his name (which is uncommon) and bank with which he has a checking and savings account with? Would I be able to garnish his bank account without any information about this person? If so, how could I go about doing something like this? The only property I know of this person owning is the car I helped him buy.

Re: locating a person

As long as you have his bank account number you

can file a writ of execution and have the money

taken directly out of his accounts. If you know

where he has the accounts and you have his name you

may still be able to get the money out of his account

without his account number. If he has closed his accounts you could

do what is called a debtors exam. I would be happy

to give you a free phone consultation and discuss

with you your various options. I can be reached at

805-546-9909 or you can email me with your information

at [email protected]. I am located in San Luis Obispo,

but I practice law throughout the state.

I look forward to hearing from you.
