Legal Question in Civil Litigation in California
I made a telephonic courtcall appearance in Orange County Superior Court (Central; C20) as a translator with my mother, whom is the In Pro Per Plaintiff, and whom is disabled and unable to speak because she had throat surgery and is still recovering. The Judge thinks that me appearing as a translator is illegal. Is he right?.. because in the past, his clerk told me on the phone that the judge said that either my mom or me needs to make an appearance...my mom has non-retained attorneys that help her on a piece by piece basis, yet the judge thinks that I am acting as her attorney, which is not true. Im just a translator and document server. ... That judge doesn't like me personally, because years ago I was an in-pro-per Plaintiff and sued a few law firms, one of which, was assigned to him, and he had a conflict of interest, because since judges used to be lawyers, they have a judicial camarederie with fellow attorneys (a judicial brotherhood), and now he falsely accuses me of U.P.L. violations.

If your mom can't speak you aren't translating, you are representing her. Sounds like the judge is right.
It sounds like the judge is right. Even if he is not, it would be reasonable for him to suspect that you are doing more than acting as a translator. A judge does not have to allow any party to appear by courtcall. Get an attorney to appear for your mother next time.
