Legal Question in Civil Litigation in California

i need major help

A while ago I was in desperate need of money, and resulted in applying for a stripping bussiness, which Im not proud of. I need to get out, but am forced to stay because the boss said he'll sue me for more than $2,500.00. I was also forced to sign a contract, IS there anythinng I can do without getting sued.

YOU MUST BE KIDDING ME!! YOU CAN GET OUT ANY TIME YOU WANT TO NO ONE CAN FORCE YOU TO WORK. I DO NOT THINK THE SO CALLED CONTRACT IS ENFORECEABLE.

You should have an attorney review the contract immediately. An attorney also could negotiate with the other party, and could also assess your risks. You should not be doing what you don't want to do. Also, California is an at-will state which means -- unless the contract provides otherwise -- you can quit at any time for any reason or no reason. Good luck!

What does the contract require? It is likely he cannot require you to perform. An attorney would need to review the agreement.

Re: i need major help

There's no way to answer with any certainty without first seeing the contract. There's a good chance that the penalty is unenforceable, so I suggest consulting with a lawyer ASAP.

Re: i need major help

Nobody can force you to work. You can try taking him to small claims court to set aside the contract. If that fails, then he can try to collect the money from you. Offer to make monthly payments of something you can afford.

Re: i need major help

He can't force you to work, but he may be pretty good at scaring you to keep working for him. You can get out, but you have to be smart about it if you want to decrease your chances of being sued. If the risk of recovery for your boss is small, or there is a chance you may counter-sue, there is a good chance he will leave you alone.
