Legal Question in Civil Litigation in California

Can I make a stop payment on a car deposit?

I am in the process of buying a car, and I found one that I thought I really wanted and put a $500.00 deposit on it. I signed a piece of paper saying that it was non refundable unless the title was not clean or there was damage to the car.

I decided later that the car was not worth the money she was asking, and asked for the deposit back. She said NO and said she would cash the check.

Can I get sued for putting a stop payment on the check?

Yes. You owe $500.00. Further, depending on your intent (ie: when you decided to stop payment), you may be liable for passing a bad check and/or other crimes. You entered a bad contract. If the title is clean and there was no damage, you acted in bad faith and would most likely lose.
