Legal Question in Civil Litigation in California
Is it Medical Malpractice for a Hospital to keep an Elderly patient confined to a hospital bed/room for 3 or more days without exercise & without having the patient leave the Hospital room? ,,,,In Prisons/Jails they allow inmates to a recreation room & exercise yard because, I guess, its mandatory by law to keep inmates "happy" or entertained.........But in Hospitals, I see patients stuck to their beds for days, and I think that's a bit mentally & physical "torture", more so, for an Elderly patient, because it's bad for the body & mind to stay immobile & only confined to a bed for days... The only time these patients get out of their hospital bed is to go to the bathroom.

Whether or not it is appropriate for a patient to remain in bed depends on their condition and course of care selected by a licensed physician. That is why in medical malpractice cases, the plaintiff is required to have an expert witness (who is a licensed person in that area of care) to testify as to what the appropriate treatment or care is for a person in that set of circumstances.
