Legal Question in Civil Litigation in California

Misuse of HOA attorney??

Can a non-board memeber of an HOA community be represented by the HOA's attorneys ? I recently won a judegement in small claims court against a person who is not on the board of directors but was appointed as head of parking by a board member..: in court, the judge asked the defendant who his attorney was, and he answered that the HOA Board supplied the attorney for this suit. Is that legal? he is not a board member nor does he work for the management company. He is an unpaid volenteer. This would mean that all of the homeowners at our HOA paid for his defense. He is appealing the verdict now , and will be represented in court by the HOA attorneys. How can he be represented by the HOA attorneys if he is not a Board Member?

Re: Misuse of HOA attorney??

If it relates to authority vested in him by the HOA, then the HOA could pay for his attorney.
