Legal Question in Civil Litigation in California
Money owed to me by ex-boyfreind (4yr relationship)
I had a 4 year realationship where I paid for items for my boyfriend and was told that I would be repaid. At the time I paid for the items he left me with the impression that I was making an investment in my future...helping him meant helping us. When our relationship ended I gave him a list of $ spent and asked him to provide proof that $ had been repaid. His reply was that all debt has been repaid.
I was extremely generous during our relationship and am only asking for the things he promised to make restitution for, can I take him to court for the $20,000 and can I sue for attorney fees ect...if we go to court.

Thanks for your posting.
What you have is, basically, a breach of contract case. You can sue for the amounts you have lost. Although you can sue for attorney's fees, the law states that except for those allowed by statute, or agreed to in a contract between the parties, attorney's fees are not recoverable.

You can bring a lawsuit for breach of an oral agreement. You will need to prove both that there was an agreement that you would be reimbursed (and that the items were not gifts), and that you actually purchased or spent the amount you claim. Unless there is a written agreement which provides for attorney's fees in the event of a legal action (and it appears you do not have one), you will not be able to recover any attorney's you may incur.

You can sue your ex-boyfriend for any money that you loaned him. Most likely he will claim that it was a gift. Do you have any writings that substantiate that it was a loan. Our firm handles cases throughout California and we will be happy provide you with free consultation once you fax me any documentation you might have.
