Legal Question in Civil Litigation in California

money

Several years ago a woman I lived with traveled outside the U.S. for six months. We were both employed before we left and shared expensed as we traveled, each taking equal amounts of funds. Before we left I put my life savings,of several thousand dollars, in an account with her and her mothers and my name so that someone would have access in the event of an emergency. When we returned we parted company and my former partner took half of my savings and moved, first to Colorado, then Hawaii. At one point the ex did send payments on three occasions and did state in a letter to me that she would pay me back. We lived in Oregon but the bank account was in California. I have written her but she has not responded. What are my options? How can I get my day in court?

If you lived together in Oregon you may sue your partner there. If she lives in Hawaii now you may sue her there. The problem is that if you obtain an Oregon judgment against your partner. You will have to then take it to Hawaii to have it made a Hawaiian judgment to do any collection work. Small claims judgments are the same as a court of record as far as collecting it. Why don't you submit the matter to one of these TV courts. When you win they pay the judgment. They seem to like these off the wall unusual situations. Although stealing money is not that off the wall.

your only option is to file a lawsuit. i have handled a number of these cases and i can tell you that your chances of ever seeing your money again are very slim.
