Legal Question in Civil Litigation in California

Motion for Discovery was Denied without Prejudice but Motion is continued?

Creditor's Motion for discovery was Denied without Prejudice, but somehow a new Motion for discovery hearing date has been set?

So was the Motion denied, or not? Why would the judge deny it, and still continue it?

Re: Motion for Discovery was Denied without Prejudice but Motion is continued?

The judge might have had an issue with proper service, or the creditor might have been slightly off in the timing of the motion. "Denied without prejudice" means that the motion may be brought again.

If you want to avoid facing monetary or other sanctions, you might want to respond to the discovery before the next hearing date.
