Legal Question in Civil Litigation in California

Neighbor cutting my tree's

My neighbor has cut my tree branches that hang over the fence 'over' their property. They then tossed the branches onto OUR property.

#1 - Do they have the right to touch OUR tree's?

#2 - What can we do if they toss them over onto our property?

Re: Neighbor cutting my tree's

1. Yes, they can cut branches that hang over on to their property as long as they don't injure or kill the tree.

2. Cut them up and dispose of them. It is not worth the hassle to get into a fight with your neighbor about the cut branches. If, however, they damage your property by throwing them back on to your property, then you should ask them to pay for the damage.
