Legal Question in Civil Litigation in California
Neighbor Harrasment
Have a neighbor a few houses down that sued us about six years ago due to our dog bitting thier son. They won through the insurance system. The problem is we have been constantly harrassed by them. They have spoken badly about us, and we have all these years, ''blew it off'' and minded our own business. The verbal harrassment continues. Their kids play in front of our house. We ask them to leave, they continue to stay. We have called to Police, they leave before they arrive. No reports made. They rent the home. We don't know who the owners are. Can I get a restaining order or something. I fear they will prevolk me to do something, like ''assault''.

Re: Neighbor Harrasment
Let me see if I have this straight. You raised a vicious dog and negligently allow him to get loose so that he attacks and bytes neighborhood children. You hold a grudge against the parents who got compensation through the insurance company because you refused even pay the child's medical bills. Then, you admit there is a real danger of you assaulting little children because they are playing in front of your house on the public street. Maybe your neighbor should call me so I can get them an injunction against you.

I don't see why you feel you have a grievance, but that may just be because you haven't provided enough details. There is no problem with their kids playing in front of your house (assuming they are not actually on your property or being unreasonably disruptive). You can't just call the police and expect them to act because kids you don't like are playing in the street near your home. If there is more to the story here than we will need to hear it. Otherwise, your concern that you will be provoked into assaulting these kids suggests that you need to exercise some serious restraint.
You say that the neighbors have spoken badly about you, but you need to be more specific. What have they said? To whom did they say these things? Are their statements true? These issues are crucial to determining whether you might have a case against them.
I'm also not sure what you mean when you say that your neighbors won their suit "through the insurance system." There is no separate system to handle lawsuits where insurance is involved. Maybe you mean that the insurance carrier settled; this is perfectly normal procedure.
Based on what you've said so far, I just don't see it.
