Legal Question in Civil Litigation in California
Neighbor harrasment
I have lived in this home for 7 years and beginning 5 years ago my neighbor began harassing my family. They have continually called the police at which the police check the circumstances and leave. One incident on New Years day regarded my 12 year old daughter who left an orange peel across the street from my house. The officer just shook his head, talked to the neighbor and left. The neighbors have told the police that I have a lot of traffic, my response to the officers: yes, I have 5 children. At one point, I told the police to tell the neighbors I was going to sue them for harassment and things calmed down for a short period. They have now resumed this behavior and have called enough people such as owner of this house, the city, police, etc. and now I am being evicted stated my family is a nuisence. I have told my kids to just ignore them and I do the same. It has become so intense and the fact that we may be homeless over their allegations and lies that I think enough is enough. What rights do I have andis they something I can do legally?

You may have a lawsuit against them for interference with contract (your rental) and possibly malicious prosecution.

If you can prove that their allegations are false, you may have a case for interference with your contract rights, intentional infliction of emotional distress, willful misconduct and malicious prosecution.
Some lawyers take these kinds of cases on a contingent fee basis.
