Legal Question in Civil Litigation in California

Neighbor video tapping my children over the fence

My neighbor was video recording my children in our backyard(1:00pm) while they were playing and doing their daily chores. He was on a chair in his own yard recording over the fence. What is the law about privacy and protecting my children?

Re: Neighbor video tapping my children over the fence

It is hard to say what the police might do. I would call them and report the incident. Tell them what your neighbor is doing. Hopefully, they will have a talk with him. If the harassment continues you may want to look into filing a restraining order. Since a restraining order needs to be filed in Superior Court the filing fee is usually between $190-$200, depending on the county that you live in. Once you file the restraining order you will have to serve it on your neighbor. You cannot do it but a friend, sheriff or professional process server can. This cost also varies but is usually around $20-$40. So your total cost is about $240 at the most. However, if he continues the videotaping after the restraining order has been filed and served you can now call the police and have him arrested. Good luck. If you have any questions or need help with a restraining order, please feel free to contact my office at 877-546-9918.

Sincerely,

John Hayes, Esq.

Re: Neighbor video tapping my children over the fence

If I were in your place, in addition to the action recommended by Mr. Hayes I would Keep My children away from this neighbor. I would also instruct them that they were not to go into this neighbors home. If the neighbor has children my children would not go to that neighbor's home to visit his children.
