Legal Question in Civil Litigation in California

My neighbors tree roots have broken my patio and side walk, are they liable?

The trees are planted right on the fence line and are now reaching through and destrorying my yard and have reached my foundation.

They overhang into my yard so far they are killing my grass as they are blocking the sun.

What are my remedies?

You have a right to cut the branches and roots back to the property line as long as it will not kill the tree or put it at risk of toppling. If that is not possible, or if you want your neighbor to pay for the damage, you can file an action and try to persuade a judge to have the tree declared a nuisance and removed. I suggest you talk to you neighbor about this and try to work something out, but if that doesn't work those are your rights.
