Newspaper tells of aids patients confidential information

i am a aids patient. i moved in to a new apartment building about six months ago.its through housing. the local news paper has ran a article telling about us having aids, and how we are all on housing and were previously homeless. i am humiliated and feel violated.

do i have legal grounds for a law suit? i dont want to live here now . and many people who didnt know about my condition do now because of this ad. this is terrible, is there not a law protecting confidential info. like this?

There is a cause of action called "public disclosure of private facts" but it is tough to win. First of all, newspapers get great leeway in printing things that are "newsworthy." Courts have found that the public has an interest in many things, including diseases. Accordingly, the newspaper probably has a good defense.

You still might have a case. If you'd like to email me the details (how did the paper get the info? what newspaper was it? were you mentioned by name? etc) I'll take a closer look at it.

You may well have a good case for invasion of privacy as well as infliction of emotional distress, and you will probably receive lots of mail here from attorneys who would consider representing you -- such as myself. You say in the first part of your post that the newspaper printed an "article" and later you say it was an "ad" -- which is it? In the latter case you would include the advertiser as a defendant.
