Legal Question in Civil Litigation in California

nieghbors rights

The tree that borders my property hangs over into my nieghbors yard.My nieghbors trims the branches along our porperty line ,with which ,I havn't problem.The problem arises when he throws all the branches and leaves back onto my side of the fence,leaving a mess for me to clean. What does California law state as the proper responce to this?

Not sure you understand your responsibilities. It is your responsibility not to intrude onto your neighbor's property, ie., keep your trees, all it's limbs and potential debris off their property. It appears to me you will be stirring up a fight you won't win by complaining to them. Might discuss matter with them.

By intentionally throwing the cuttings on your side of the trees, your neighbor technically is trespassing. A nice note -- telling him that you're trying to be good neighbors and enjoying the relationship -- could go a long way to resolving the situation before it escalates. Keep a copy of the note.
