Legal Question in Civil Litigation in California

Non payment of a family trut fund

I was to receive my trust fund at the age of 21. I am now 29. My father was the benefactor of the trust and the trust agreement was written into my parents divorce papers back in 1988. I have already requested the divorce papers from the Superior Court. As of today's date I've not received a dime of the money as my father has not released any of the monies due tohim claiming that I was not mature enough to receive the funds. (Please take into account that I have had no problems with the law, drugs, gangs nor any other situations for this statement to hold up). As far as I know the original account was not set up and only when I was 19 did he open a checking account with both of our names that had $10,000 in it only a fraction of the total. This money was used by me and my mother to pay off many bills that we were incurring . I briefly lived with my father at the time of my 21st birthday at which time I was told that I would not receive the money now because he was to be using it to start a company which he still has. There were no papers signed by either party and this was ony said in passing

Who do I need to contact, a family atty or a trust attorney? What should my next steps be? Can I do this as a contigency case?

Re: Non payment of a family trut fund

You have a trust dispute. Attorney fees are always negotiable as to whether they are paid in contingency or hourly. You should consult with a lawyer.

Re: Non payment of a family trut fund

You have a very interesting situation. Do you know how much money was supposed to be placed in trust for you? Do you know any of the terms or conditions that were to be placed on distribution of the trust income and principle?

I think you have raised more questions than can I can even attempt to answer at this point in time. I would be happy to speak with you about this matter.

You may have a lawsuit. If you fax me at 714 363 0229, all documentation you have I can provide you with free consultation. You can also call me. Basically, there may be a statute of limitation problem. Also, such trust funds may be kept in a blocked account.
