Legal Question in Civil Litigation in California
In a non traditional Los Angeles limited unlawful detainer complaint- that has been adjudicated without the requested jury trial or Defendant's petition for fee waiver and when possession has been obtained by the Plaintiff.
Is a petition for trial de Novo reccomended or appeal? If an appeal is started... is it possible to close the appeal and resubmit the petition for trial de novo on the basis of fee waiver and jury trial denial.?

If an appeal is started, it's too late for anything else. Stick with the appeal.
