Legal Question in Civil Litigation in California

nuisance abatement

One of my neighbers has put in 65 crowing roosters. The property is A20 which allows poultry. The roosters crow constantly starting at about 3 in the morning. If I take him to court to try to abade the noise nuisance do I have a chance of winning. Would it be in small claims or civil court.

Re: nuisance abatement

It would have to be civil court. You might have a pretty good chance. There are a lot of cases where the area around a property changes to the extent that the prior zoning becomes inappropriate.
