Legal Question in Civil Litigation in California
obtaining a restraining order against a neighbor
with over 20 yrs of harrassment and petty phone calls to police over having yard sales and such..reporting the neighborhood for having commercial truck in their driveway, or for having motor homes..in driveway..antique cars..etc..now this next door neighbor after me and my family moved in with my elderly parents threatened our workers not to put up the wall between us and him , and also called to report us having a container in our driveway due to we are remodeling and have to store mom and dads furniture cause of demolition..also the work truck we are using for hauling when we start in a month..or so..the truck is over 6,000 lbs...flatbed...not diesel truck or anything like that..and the container is 20 ft by 40 ft against our wall not near street by over 12 ft and not anywhere unsafe for the neighbor..the county told us we didnt need a permit for the container but he had an inspector out and we seem to be breaking laws here..we need help..this guy wont let us live in peace...thank you...

Re: obtaining a restraining order against a neighbor
I'm not sure what your question is, but you have the right to use your property in any way that does not violate the law or agreed neighborhood restrictions. Also, I don't know what you mean when you say the neighbor "threatens" you or your workers. If your neighbor is making physical threats, he could be arrested. If he's threating to violate you on restrictions or building codes, you should consult a lawyer or your contractor. The city has already told you that the container is not a violation. Forget about the inspector. I would demand that your neighbor put his concerns in writing and mail them to you. That way you have a record of what he wants.
