Please understand that this is not legal advice. You should consult with an attorney because this definition could be wrong or it could be right, but not applicable to your situation. That being said, I THINK an offer could be defined as: 1.) present contractual intent; 2.) with certainty and definiteness; 3.) communicated to the offeree.
It can also be defined as the manifestation of a willingness to enter into a bargain, so made as to justify another person in understanding that his assent to that bargain is invited and will conclude the deal.
It has an objective standard. For example, could another person reasonably believe that by assenting to the terms of the offer an enforceable bargain will be concluded.
