Legal Question in Civil Litigation in California
Im not sure of this one/Landlord Tenant ?
The owner of the apt. complex sent me one letter pertaining to a raise in the ''late rent fee, from 35.00 to 50.00 per incident, and the fact that the noise and all the traffic in and out of my apt. I had been talked to about the traffic, never the noise,by the manager here on the property already once and I don't have anymore noise nor do I have alot of traffic. Within this letter regarding the late fee raise it also mention the fact that I needed to call an ambulance for my stepbrother who became really sick since his arrival that morning, ''the other tenants were concerned, and they have never dealt with this before, considering it is a nice quite complex. The second letter the owner sent, she lives off site, pertained to the affect that my girlfriend was visiting and her boyfriend was arrested in the parking lot for driving a stolen car. I was given the option in this second letter to give her my 30 day notice to move or she would evict me. Can she do this? I have done what she and the manager have asked, I had no control over what happened with my friends boyfriend arrest, and I don't make any noise, I have a roommate who works and is on a rotating schedule so its hard to have alot of Traffic noise.
Thank you Leslie Smith

Unless you live in a rent control city, the landlord can give you a thirty day notice (60 day if you have lived there at least a year) for any reason or for no reason.
Try to discuss your situation with the landlord and work out a compromise. You can also ask the landlord to go with you to mediation. Some cities and some housing organizations like Project Sentinel offer free or low-cost mediation service. Most landlords do not want to evict a tenant who pays the rent if the situation they are concerned about can be improved.

I agree with Mr. Snitow UNLESS you currently have a lease in place that is for a period of time longer than month to month.

Sorry, but this is an area of law that I am not familiar with.
