Legal Question in Civil Litigation in California

Oral Depositions

I have already given an oral depostion in a case I am a defendant to. Subsequently, a related case was filed against me. Can I be desposed again, and is there any limits as to what they can ask me? Can they ask me about the first case deposition or facts relating to the first case?

Re: Oral Depositions

Thanks for your email. You can be deposed once per case, so if a separate (even if related) case has already been filed, they have the right to ask you questions again. You may want to make sure they have a copy of your prior deposition (so long as nothing in there is damaging), and then state that you will only answer questions related to areas not covered in the prior deposition. That might limit you from being asked questions twice. Thanks, and if you would like someone to attend the deposition with you or write letters on your behalf, I'd be happy to help. Email me or call me at 1-877-568-2977.
