Legal Question in Civil Litigation in California

I ordered something online from Nordstorm they put the wrong address on the package the mail carrier deilivered it to the wrong address the seller has refunded me my money for the merchandise can I still take legal action against the person who has it and will not return it I already told the seller I that I have not recived the package I even checked with neighbors next door

Funny, I had the same experience with Amazon. What are they smoking up in Seattle? You have been made whole. The package now belongs to Nordstrom, or to some insurance company. In legal terms, you lack "standing" to take legal action. In colloquial terms, you have no dog.

If you were refunded the money, what do you care that the goods were delivered to someone else? As Mr. Stone points out, you have been made whole. Just reorder what you want and make sure the address is correct this time.
