Legal Question in Civil Litigation in California
If somebody owes me $2600 and this is documented with a promissary note but they refuse to pay, what is the most I can sue them for in small claims court?

The unpaid amount of the note, plus interest. You only have to move up to Superior Court - Limited Jurisdiction when your claim is over $7,500.

The legal rate of interest is 10% simple per annum from the date payment was due. Thus, if payment was due one year ago, you can sue for $2,600 + $260 interest or $2,860. For less than a year, you can prorate the amount of interest, but you cannot compound it.
