Legal Question in Civil Litigation in California

party's addresses on answer to complaint

can party in lawsuit refuse to state true residence address on answer to civil complaint? Instead use

mail drop company, such as "Mail Box". Same with

telephone number, using answering service?

What code or Rule covers? (San Diego County)

Re: party's addresses on answer to complaint

There must be an address on the answer that the court can use to send official notices. it does not have to be your home address.

Re: party's addresses on answer to complaint

Rule 201(f)(1) of the California Rules of Court provides the answer.

The rule states that the face page of any paper filed

in the court must state certain information identifying the person

(attorney or person filing in on his or her own behalf). The

required information includes: "office address, or, if none, residence address . . ."

The rule is interpreted so as not to permit mailboxes. The reason

is that one must allow papers to be hand delivered to the address

given. The other parties cannot hand deliver papers to be served

at an address that is only a mailbox.
