Legal Question in Civil Litigation in California

Payment negotiations after response filed in civil matter

I am being sued by an auto ins. co. for damage to their insured's vehicle. My ins. was lapsed at the time. I filed a response to the court through a paralegal. Is it possible to request a payment negotiation with the ins. company, sans laywer? I am trying to avoid court and a probable judgement against me without the high cost of an attorney.

You can call the attorney who represents the insurance company and try to negotiate a deal. This is done quite often. Good luck.

A case can be settled at any time during the proceedings and you can try to negotiate a settlement at this point. However, as the case has been filed and answered, it will go to trial unless it is settled ahead of time. If you are unable to negotiate a settlement with the insurance company, you should consider retaining an attorney. This course of action might be cheaper in the long run.
