I want to take a person to small claims court for refusing to pay to smog a car he sold me. He lives is a different county, which county should I file in?

You can sue in the county in which the defendant lives, or the county in which you purchased the vehicle.. For example the defendant lives in Santa Cruz county and that person placed the car for sale in Santa Clara County you could sue in either county. Check with the court about a small claims court clinic in your community. An attorney at the clinic will help you with this question and the evidence that you need to present at court. The vehicle code provides that the seller must smog the vehicle. Good Luck
