Legal Question in Civil Litigation in California
Police Misconduct
My mom is deaf and had a misunderstanding with a Sheriff's Deputy when he was telling her to move her vehicle off the street. He slammed his hands on the window and ordered her out. She didn't know what was going on and opened the door to ask him what was going on. He pulled his gun on her and pointed it in her face. She got out and roughly pulled her arms and handcuffed her, then pushed her to his vehicle. She tried to tell him she was deaf and didn't understand what was happening, but he said ''I don't care!'' Is there any action we can take against him? What should we do?

There may be an action against the police department. However, there are a lot of facts which I will need from you in order to properly advise you. Feel free to contact my office at, 818.385.0520.

I am sorry this happened to your Mom. If she was injured in any way, have her obtain medical attention as soon as possible. The conduct of the officer may have violated your civil rights, and may have constituted illegal disability discrimination against her. If she were to retain an attorney, she should ask questions regarding that attorney's spcific experience with disability law and with police misconduct litigation. If this incident occurred in Los Angeles or Orange Counties, I would be pleased to offer a free consultation with her. Time limits for filing lawsuits against public employees and their employing entities can be very short, so she would need to consult a lawyer right away to find out what her rights are and how best to proceed.
