Legal Question in Civil Litigation in California
potential breach of marriage settlement
In a marriage settlement agreement,
he was to give 50 % of earnings after
expenses for three years from a
company started with his now x-wife.
Upon receiving her first year money,
she requested seeing the books to
ascertain that she was indeed getting
half. He not only refused to show her
the books, but claims he is sole
owner of the company when in fact
she still owns 49% of the stock. He is
supposed to get the stock at the end
of the three years once he has paid
her for those three years. She also
has good reason to believe that he
has taken 50,000 out of the matte
world account to help with the down
payment of his new house. What are
her rights and what could happen to
him? Has he acted illegally?

On the surface it appears that he is in violation of the Marital Settlement Agreement. If this is the case, you have several options, depending on the specific facts of your case.
You should consult with an attorney in your area with Family Law and Civil Litigation experience.
