Legal Question in Civil Litigation in California
problem with body shop & insurance company
On June 11, 1999 I took my 98 Jeep to a body shop to have damage from a wind storm repaired. Over 4 months later I still do not have my Jeep. It has been painted 3 times. First time it peeled, second time color was wrong, third peeled again. In this time the shop has also ruined other parts by getting paint and fallout on them - Steering wheel, frame, suspension, interior, door handles, dash, electrical componets, ect. Some parts where cleaned with chemicals that ruined the finish. The shop also did not do the job as quoted by the insurance company, they cut every corner they could. I called the insurance company and was told to bad, I picked the shop and it's my problem not theirs. They said once they make out the check their part is over and they are not obligated to do anymore. I do not see how my Jeep will ever be right. To me it is no longer the Jeep I bought. I'm afraid I will have more problems years to come from the work the shop performed. Am I out of line to ask the shop to replace the Jeep with a new one ?

Re: problem with body shop & insurance company
If you signed a release you cant go after the insurance Co. but you still might have a claim against the body shop. Go to a good shop and get an estimate on a quality paint job and then take them to small claims court.
