Legal Question in Civil Litigation in California

procedures to file at small claims court

after purchasing my condo, the kitchen appliances were covered by a warranty. The dishwasher failed and needed to be replaced. This was covered fully by the warranty company, however during installation of a new dishwasher, the delivery company ( subcontracted by the warranty company )flooded my kitchen causing major damage to my property and my downstairs neighbours place. My insurance covered most of the cost however i am still out of pocket the deductable and the charges for the call out of the plumber. How do i file this claim? can i do this online? What can i claim for i.e my inconvenience? is there a time limit? How long does this pocess take? thanks.

Re: procedures to file at small claims court

Click on http://www.courtinfo.ca.gov/forms/documents/sc100.pdf, fill out the form, and submit with your fee (I think it's now around $25) to the small claims court near your home. If in Los Angeles, go to http://www.lasuperiorcourt.org/locations/ and plug in your zip code. If elsewhere, check with your local courthouse. Make sure to properly identify all of the people you wish to sue.
