Legal Question in Civil Litigation in California

Property Line Laws

Simply put. My neighbor's trees were encroaching upon my property to such an extent, that the branches as well as the leaves were in my pool. I requested Her to please cut/trim her trees as the various foliage, branches, leaves etc. were requiring me to skim and clean my pool on a daily basis, (or deal with plugging up my filtration system). After several requests, and with no results, I paid a professional tree trimmer to cut the trees, straight up the fence/property line. After discovering this, she has sued me for damages, (asthetic) to her trees, via small claims court to the tune of $4,000+. The trees are very healthy but they're overgrown on her side now. Do I Have The Right To Cut The Trees That Are On My Property?? Hurry! I NEED answers! Thanks!

Re: Property Line Laws

You have a good defense, I would also counter sue for trespass.
