Legal Question in Civil Litigation in California

If I publicly show that the guy who got an ex parte TRO against me tried to keep me from having a lawyer, what is the worst that he can do to me? It was turned into a mutual stay away (now expired). I wish my attorney had advised me to attend the hearing; maybe that is why it wasn't totally dismissed. I did not want to go, if unnecessary, because this guy raped me. I didn't want to be in the same room with him.

The problem now is, I might as well be a criminal, as far as the police are concerned. This rapist got away with it, because he preempted me with the false accusations in his TRO. (It was friend rape, not stranger rape, if you can't tell.) He forced ME to be on the defense by taking ME to court first. When I went to the police about the rape, they investigated ME instead. I know, because they called other people about me. I want to publicly post an email from my (former) attorney in which the attorney states that this man (the rapist) tried to convince my attorney not to represent me. I want to be vindicated. I can't prove that the abuser raped me, but I can show that he attempted to stop me from having legal counsel. That's better than nothing. Can the rapist do anything to me, legally, in retaliation?

I'm sorry to hear about your ordeal. But I'm afraid we can't answer your question based on the limited information you've given us. Whether he could successfully sue you (whether for damages or a restraining order) will depend on the underlying facts, as well as on what you say and where and how you say it. Note, though, that he might sue you even if the law isn't on his side. You would still have to defend yourself, which can be expensive and emotionally draining.

If this is something you very much want to do, I urge you to invest in a few hours of attorney time to guide you. It could spare you a lot of aggravation down the road.

Good luck.
