Small claims suits are civil suits, they are just governed by special rules and have a limit on damages on how much you can seek. I suggest first speaking to the small claims advisor at your nearest courthouse to determine whether small claims is right for you. Most law libraries also carry a book on representing yourself in small claims that is published by Nolo press, and some court clerks will give you a free copy of a brochure that covers small claims proceedings in California.
