Questioni want to know if i have a case.
my daughter is on my cell phone account. her ex husband constantly calls and hangs up so she changer her number. she has a restraining order against him and he has a felony warrant for stalking. he moved out of state and got a job as a customer service agent for the same cell phone company we have an account with. we found out he tricked a co-worker and hacked into my account to get my daughter's new phone number. the company has advised me that he and the co-worker have been fired, they also advised me that they did do a background check but did not know of his warrant or record.

Do you mean a case against the cell phone company? Maybe, but unless you can show some harm that you or your daughter suffered as a result of the company's negligence, it may be too small to be worth bringing in a traditional court. Small claims court might be more appropriate.
I realize that what happened is distressing. You might be able to win a small judgment for that distress, but probably not enough to justify anything more than a small claims case.
I might see things differently if I had more facts.
