Legal Question in Civil Litigation in California

I am on a real estate loan with my ex, I deeded off the property at the time the MSA was drafted with an agreement that he would refinance to get my name off the loan, 3 years later and monthly late notices, I am stuck on the loan indefinitely due to a poorly drafted MSA. Can I file a civil action against my ex or does this have to remain in family court?

It is a family court issue under the same original case and case number.

I agree with Mr. McCormick. Regardless of the approach either by way of motion to correct the MSA or vacate the MSA and judgment, or enforcement, it remains in family court with that case number.
