Legal Question in Civil Litigation in California
Recently, Blizzard Entertainment started what was called an "alpha" for a new expansion pack of their popular online game, World of Warcraft. An alpha is essentially a private server with new and unreleased content, which only select people are allowed to access, for the purpose of playtesting and giving feedback. In order to access this alpha, you must sign a Non-Disclosure Agreement. If the information inside the alpha was leaked, mainly pertaining to pictures of the new content for players to experience, and a person who did not sign the NDA got ahold of it and posted it on a website freely for anyone to see, are they somehow legally accountable? Could Blizzard entertainment issue a cease and desist? Since they did not sign the Non-Disclosure Agreement, would this be fair use?

If you did not sign and it is not in any way stealing, you should be okay to post. I would do it anonymously just to be safe.
