Refund

My daughter played on a travel softball team overseen by our local youth organization. We paid money for her to participate on this team. The fees we paid went toward her uniform, and other items required to participate. (ie: insurance, tournament costs, registration etc.)We paid $350 out of our own pocket and $197 from fund raiser. After participating in three tournaments and several practices she quit the team. There is $194 left in her account. We are trying to get that money back. The over seeing organization is refusing to give us our money back. Is there any legal basis for this or am I intitled to this money back. (36% of the total amount in my account was from fund raising. I am only asking for a remaing 64% back). Do I have grounds to take them to small claims court or am I just out this money. FYI: When girls drop out of the recreation league money is refunded without question.

Please help. Also I never signed any paper work stating that once money went into her account, the money would stay with the organization even after you leave.

It's difficult to say whether the money should be refunded without looking at the rules and past practices. It sounds, though, like the money already has been allocated -- i.e. for insurance and equipment. Those are things that don't seem to be capable of pro rating. When I was in little league, it cost my parents, I think, $5. That was some time ago, I guess. -Robert F. Cohen, Esq.
