Legal Question in Civil Litigation in California

Removing name off vehicle title

I took out 12,000 dollars out of my retirement as a loan and purchased a vehicle. Both my name and my now ex-fiancees names are on the title with and not or. The retirement co. takes weekly payments out of my check to repay this loan. He has stolen the vehicle once( I stole it back) but now I have to keep it locked up in storage until I can get his name off the title. How can I get his name off the title, he refuses to sign off the pink slip and says I owe him money?

Re: Removing name off vehicle title

You have to go to court. There is no out-of-court "self-help"

way to change the title without the ex-fiancee's permission. A

court will have to hear the claims about ownership, money owed,

etc. You may be able to get a temporary order giving you the right

to use the vehicle in a Domestic Violence action (if there is a ground

upon which to file one), but not a final answer.
