Legal Question in Civil Litigation in California

repossesion

is it legal to break into private property thru a locked gate and then break into locked cargo containers to reposse a item?

we sold our house and were moving and put all our possesions in cargo containers....and a repo/recovery company repossed our atv, by breaking in thru a locked gate, breaking into 2 locked cargo containers (each had approx. 4 locks on them on private property.

they broke into both containers(1 belong to my brother)...when the movers got there witht the keys i sent them, the atv was missing and there are items belonging to my brother and sister and my self that are missing.. we recieved no notice of repo ...

Re: repossesion

This was a violation of the Fair Debt Collection Practices Act (if it was the repo person). File a police report. Take photos. Call a lawyer in your locality.
