Legal Question in Civil Litigation in California

Request for Production of Documents (Civil)

I am being sued in civil court for failure to pay on an investment of $24,000. I do not have an attorney and the plaintiffs atty has served me with a requests for production of documents, they want me to provide all my bank statements (all accts) employment information and any corporations or dba's that I have. Is there a way legally that I can refuse to give this information. I do not dispute that the plaintiffs are owed these funds.

File objections. Go to a law library and look up how to respond when you want to object to something. However, they can do a motion to compel.

But if you do not dispute that the money is owed, why don't you just settle the case?

Like many legal questions, the answer is "It depends", which is not all that helpful. If you cannot afford an attorney to assist you, I suggest going to your local law library and asking for "Civil Procedure Before Trial" (Rutter Group) and look at the chapters on discovery. This will provide you with an overview of the types of objections that may be valid in your case. If you don't dispute owing the funds, your time may be well spent negotiating a creative solution. For instance, what about a payment plan where you are forgiven interest, attorney fees, etc. if you make all the payments on time? This shows that you are serious about making payments and gives you a break if you perform.
