Legal Question in Civil Litigation in California

How do I know if a Restraining Order has been filed against me

A family member informed me that there was a restraining order that was filed two years ago for a verbal argument that occurred two years ago with another relative. I was never served, nor did I know of this. How do I know if one was filed and protect myself from any false accusations that were made?

You could call the local police department and see if they can help or go down to the main courthouse and look you name up as a defendant in the index of cases to see what legal actions you have been involved in [check first that this time of order is the public records or not]. Many courts have web sites where you can look up suits.

As to doing something about it, it has been two years if it was filed [you should have gotten notice of a hearing] and it may not be worthwhile to do anything about it. You would have to go to a criminal law specialist to find out if it is worthwhile and how much it would cost.
