Legal Question in Civil Litigation in California
restraining order
I was issued a restraining order
WITHOUT due process. That is to say,
I was never servied, there was never
a trial date set, I did not have the
opportunity to retain council and the
judge simply pencil whipped it
through the system.
Do I have a case against the judge?
Can I get it reversed? How long do I
have to contest this illegal action
against me. Can I go after the judge
on this one? Who do I report this to?

Re: restraining order
You don't have a case against the judge. You may be able to challenge the order either in the trial court and/or on appeal, but I would need more facts before I could say whether or how you could do this.
Re: restraining order
Bad decisions are always appealable. Your query is subject to detailed study of your case and decision of order of the judge.
