Legal Question in Civil Litigation in California
Restraining Order
I moved into a house with a man, i have been here 1 month. Initially we both applied for rental. The owner of house and roommate (Steve) took my name off of rental application, unbeknowst to me until later. Steve called me from work stating he had a tooth ache, said he was coming home I haven't seen him sense (incidently he went home to his mothers). He stayed in house 2 nights.
Now he is harrassing me saying he is going to get a Restraining Order on me so
I will move out of the house so he and a guy friend can have it. Moving is O.K., my question is can he get a Restraining Order against me for such a reason? I
have done nothing to this person. It cost me $1500.00 to move in here with him. Now I am broke and he expects me to just get out!! Also he owns nothing
but the shirt on his back, he doesn't even have a vehicle. I have all furnishings for a 3 bedroom home, my point being its just not that easy to move. He says with a Restraining Order I will have to walk out of this house and leave all my worldly possessions including a $30,000.00 drag bike (Harley Davidson) that is sitting in the garage. I am a pre-law student finishing my BA (online) at current so I am not employed. PLEASE HELP ME.

Re: Restraining Order
Based on the information you provided, YOU are more likely to obtain a restraining order than he is.
In fact, calling you and harassing you is a crime. I would suggest that YOU file for, and obtain a restraining order. Since you may be unable to hire an attorney, there are several groups which may be able to assist you with the process.
Good Luck!

Re: Restraining Order
Based on the facts you have detailed I see no grounds for a restraining order.
