Legal Question in Civil Litigation in California

Restraining order requirements?

I have been threatened with violence by another tenant in a shared housing situation. I have heard of restraining orders, and am curious to know what are the requirements that need to be met to be able to obtain one against a person? In other words what exactly would have to occur against me by the threatening individual to have a realistic chance of obtaining one to protect myself from potential harm?.

Restraining Order Requirements

California Code of Civil Procedure Section 527.6 (which you may access on line) sets forth the grounds to obtain a TRO against harrassment. Essentially, it is a course of action that seriously alarms or annoys one and would be expected to cause emotional distress in a reasonable person. If this applies to you, you may obtain the approved California Court Forms which will easlily guide you through the process.
