Legal Question in Civil Litigation in California

Restraining Order

My son's ex-girlfriend just put a restraining order on him however she keeps trying to contact him by e-mail. Does this revoke or cancel the restraining order?

Re: Restraining Order

It appears that she is attempting to get evidence that he has violated the restraining order. It is not a violation of the restraining order, but it would be a violation of the restraining order for him to respond to her attempts to contact him. He must be very careful to avoid any contact with her. If you are refering to a temporary restraining order and there will be a trial regarding a longer restraining order, you should immediately contact an attorney and oppose the restraining order.

Re: Restraining Order

It does not revoke or cancel the restraining order. It may, however, be grounds for him to get a restraining order against her.

Your son needs to be careful. It would appear that his ex-girlfriend is attempting to get him to contact her, to cause him to violate the restraining order. I have seen this kind of thing before. If he violates the restraining order by contacting her, he can get into a lot of trouble.

She sounds like a mess. He is best rid of her and should get on with his life as best as possible.
