Legal Question in Civil Litigation in California
Re: Retaliatory Evictions
What are the possible ''outcomes'' for a tenant, if they were to win their case in an Unlawful Detainer action, when their defense was: the landlord breached the implied warranty of habitability, and then filed an eviction action against the tenant for complaining about the condition of the rental unit(Retaliatory Eviction)? Also, What proof would I need to have in order to win such a case?

Re: Re: Retaliatory Evictions
Sounds like you may have a Civil Lawsuit. In addition to attorney fees and costs you may be able to claim malicious prosecution, abuse of process, retalitory eviction, breach of the warranty of habitability, violaiton of the Fair Debt Collection Practices Act, etc. I am in San Bernardino County. If the judgment was in San Bernardino County I would be willing to look over your documents and advise you further.
